Presents a dramatization of the sentencing phase of a trial of a convicted murderer. Presents arguments for and against capital punishment., Dramatizes a courtroom encounter in the not-too-distant future, where attorneys argue whether or not capital punishment comprises cruel and unusual punishment under the Eighth Amendment. Argues the pro's and con's of whether the concept of retribution should be part of the legal system, defines punishment, and asks whether cruel and unusual punishment is a deterrent against crime. Pictures the judge stating that there are three principal issues in the case--deterrence, retribution, and progressive moral standards--and concludes open-endedly as he prepares to decide whether or not the Eighth Amendment should be imposed in this case.
