home where are you coming from i was visiting my girlfriend he came by and he offered to to drive me home i don't even know him i'm not going to advise you of your rights have the right to remain during questioning if you so desire and cannot afford one attorney will be appointed for you without charge you understand each of these rights as i've explained them to you yeah you wish to give up be home by now look they're they're really gonna be mad if they hear about this do you know who this car belongs to do you know if you had drugs in the car did you know that he was smoking pot well he and the girl were arrested and brought to the police precinct station because they were juveniles their parents were called no charges were made against the girl and she was sent home the boy however was detained for the night and held for further questioning within 24 hours after the arrest the probation officer filed a petition with the court alleging that the boy had committed certain crimes copies of the petition were sent to the boy's parents the prosecutor's office and the defense attorney assigned to the case count one possession of amphetamines two possession of marijuana three grand theft auto four driving without the owner's consent this police report says they found a large knife in the car's trunk you have priors for narcotics and pot smoking and you have two outstanding traffic warrants we think about all this fred i still can't see what i did that was so bad was this report true or not not really no okay and tell me what isn't true that knife bit for instance it wasn't even my car hell there could have been a dead body in the trunk for all i know okay uh what about the amphetamines they found in the car did they belong to you look those cops had no right to stop me they were answering a burglary call they see you tearing away from the scene that makes you a first-rate suspect they had plenty of cars to stop you i had nothing to do with the burglary i was trying to get away from there how do they know that i still don't think it's right to stop a person and search him well it says here the officer ordered you out of the car and that he eyeballed the marijuana butt on the floorboard is that true fred were you smoking pot or not yeah yeah i guess so but so what a policeman eyeballs you with marijuana he has every cause to search you oh that's stupid maybe it's still the law whether you agree with it or not okay what were you gonna do with that stolen car i didn't steal the car hell i know the lady who owns it she lives down the street i only wanted to borrow it for a couple of hours okay the police find you in a stolen car they have every right to search for further evidence and any evidence they find will be admissible in court then a hell of a mess buddy so what can you do to get me out of it well the prosecutor may have a problem proving possession of amphetamines but they've got your colon marijuana now if you admit the petition he might recommend reducing theft auto to driving without owners consent so what'll i get well if you admit it i might get your probation i'll get probation anyway don't kid yourself the judge could be tough he could send you to state youth authority if he thought it could do you any good in any case you're going to be remanded to traffic court because of your outstanding warrants and they can put you in jail or fine you what happens if i don't admit to it then you get a trial i'm innocent until proven guilty right right so what if they can't prove it well then you get off clear what do you want to do what would you do [Music] fred decided to admit the petition the prosecutor and the probation officer agreed that the allegation of grand theft auto might be changed to driving without the owner's consent the allegation of possession of amphetamines and possession of marijuana was not reduced after fred's rights were fully explained to him his admission was accepted by the juvenile court judge fred was ordered to appear in court again in two weeks for his disposition hearing in terms of your disposition which i have read to you are contained in this court order you'll receive a copy of it now in two weeks you will be 18 and under the law an adult you're a very lucky young man you'd committed these offenses on your 18th birthday or after you could have been treated very differently if you acquire a criminal record as an adult it will interfere with your future job possibilities the price you'll have to pay for insurance your travel and foreign countries civil service examinations your voting privileges enlistment in the armed forces and your participation in other government programs your future depends on the choices you will make now you think about that you're committed to the state youth authority the sheriff will transport the minor to the state youth authority forthwith fred was made award of the court and committed to a youth camp and because of his history of narcotics use he will participate in a drug rehabilitation and work program a progress report was scheduled to be made to the court in one year so that fred's improvement could be evaluated if the report is unfavorable his wordship will be continued but if the report is favorable his warship could be terminated or he could be returned home on probation under the supervision of a probation officer in traffic court his driver's license was revoked [Music] uh [Applause] [Music] you
