for I is is I love those fake slides at the end um because that was something that uh was actively used um things like please remove ladies please remove your hats um and uh yeah other things like that hi I'm skip Alzheimer welcome to the a Geeks lunchtime streaming show where we watch old 16 millimeter films and that was uh a film from the Mogul Brothers collection I've shown some of those uh courtesy of the orgon archive but that was actually um from the prelinger archive because the Mogul collection um ends up in lots of different places and so that's where that came from anyways uh let's see what we got um in figures try to figure out what let's try to guess and see what year we think this is because I don't know I don't have information about the year but maybe we can find some context clues that will help enjoy [Music] in presenting it figures we that's the wrong figure how you ever get in here let's start again craft presents it figures featuring people you all know the grocery store operator his dairy clerk a shopper Dairy space competition he really swings out doesn't he well well a human being welcome sir this is Joe a craft salesman Joe like all craft salesmen tries hard to boost his sales and he knows der has a big sales potential but Joe has problems the worst probably is the way that character Dairy space competition keeps cutting him down he cuts the store operator down even more but the store operator has so much else on his mind look here Mister Dairy space competition couldn't hurt you as much if you had more refrigerated display space study the record of dairy sales and profits and you'll see you probably know you can use more help too your dairy clerk is a hardworking gal but she has a lot to do besides taking care of the dairy Department the stock in the dairy case is getting low he says and I says what stock I sweep floors I work the checkout stand there's not much cheese at all in the case except a slow moving brand well let them take that I got to Mark the prices for the grocery department busy little bee that's me not my job but he tells me I do it sweep the floor stamp prices for the grocery department poor guy too busy to bother about the dairy department so am I too little will display space for the dairy Department not enough help to keep the dairy Department in order what's the result a jumble I'll get to it as soon as I can sweetie the products people want out of stock well I can't be in three places at once and look who's coming I'll buy it if I know it if I see it but I don't see it so I don't buy lost sales and to complicate the situation here's fat man again look what he's doing now subjecting the store operator to price cutting pressures more unknown unadvertised Brands dumped into the cave crowding out Brands customers want the fast selling advertis products that deserve a good display from the standpoints of both profit and customer demand too often the last salesman who calls not store personnel or profit considerations determines display size Joe you just got to get through to the store operator for his own sake as well as for yours you like every craft salesman are recognized nationally as a dairy Department consultant yes you are looks good too and it means you're an expert in helping store operators realize all possible profit from dairy departments come on Joe try getting through to him that's it know you he respects you you can help him develop a dairy Department that produces 10 to 14% of the gross profit and at the same time act as a store traffic Builder but as a craft consultant you've got to go still farther show the store operator how to ring every possible Penny of profit from every square foot of space in his Dairy Department give him the facts and the figures these Progressive grocer figures are real eye openers profit per square foot per week of store space and well-managed supermarkets produce averages $133 gross profit per square foot per week meat $69 Bakery 89 tell them to hold on Joe here it comes Dairy $35 per week per square foot the highest of any Department in the store so far so good Joe he's got a picture now of what can be done in his own operation the next step is to help him make a study of his Dairy Department he probably hasn't realized the importance of it because Dairy is usually hidden under this key of the cash register and is usually supervised by a manager whose primary interest is meat or groceries so what that's no obstacle is it Joe hav't take a look at the plan the plan is a new plan but its Effectiveness has been proven it will show that a well-balanced dairy Department boosts store profits no matter who supervises Dairy first Joe gets the figures on his fast moving items when you have the figures you'll no no Joe not this figure you want the sales figures have to watch these salesmen all the time that's better figures tell you 60% of d purchases are made on impulse so products that customers like must always be handy where the customer can see and reach for them to make this clear to your friend let's represent fast moving items with a blue band that's the way impress it on his mind next represent slower moving duplications with orange non-dairy items as black now here's the way to to start those extra profits rolling in Joe fast selling items need extra space enough so they don't go out of stock for the heavy buying of rush hours help your friend to remove slow selling duplications their stealing space that could be making a faster profit remove non-dairy items from the dairy section give them a place to themselves they steal profits here and they also confuse the Shopper now now there's a chance to allocate space to each item based on its actual sales volume blue gets the most space orange less of course let him see how it works watch impulse buying delicious I'll buy it if I know it if I see it and if she can reach it but if the item she wanted hadn't been on display Bingo there' have been no sale no profit things would have gone like this here's a dairy Department before it had a plan what a mess want cheese you see hering the operator who runs this place must be a mixed up kid sure non items often have a high margin but their turnover is slow nope and what good are high-profit items that don't sell especially when they take the space fast selling items ought to have and when the fast selling items are out of stock their profit loss I can't restock during rush hour sweetie I have to operate the cash register the store operator without a dairy plan is familiar with this too Joe out of stock too bad he offers her a substitute just as good lady just as good watch now thinks he can p off a substitute on me you do remember situations like this don't you I'm helping you put it over Joe what you did by not having a stock of the fast-selling item was to virtually Drive the customer out of the store into the arms of your competition wasn't it and with her went your profit Joe we're at the point now where you can make the plan stick offer to demonstrate how he can realize real extra profits from Dairy Taylor make the plan for his store the first step is to take a beginning inventory at his Dairy Department the dairy clerk can help too by keeping a record of purchases made from store door and Warehouse deliveries made during the week at the end of each week you take another inventory Joel and thus you have recorded all the facts you need to show actual sales the beginning in inventory plus weekly purchases subtract the end of the week inventory and there it is his weekly sales figure you do this each week for a month Joe and then give them the figures plus your analysis of overstocks and underst stocks this is the basis for the tailor made balance Dairy Department Plan eliminate slow moving duplications wherever your inventory shows the space can be more profitably used by fast sellers you've got figures and with these figures you and the store operator can lay out his Dairy department so it will produce the most possible profit by allocating every inch of space according to his sales potential based on your figures demand items are placed along the length of the case to draw traffic margine milk butter and eggs looks like they've cleaned up the joint looks nice too the layout of items is balanced that is each item is given space based on its rate of sale cheese is displayed in groups according to type and variety specialty cheese for example is placed together this is enough to make a girl squeal with delight also placs together are foreign natural process and cream cheeses I think I will squeal with delight wooo [Music] altogether you've given the star operator an attention getting department and a balanced case for all dairy products delicates and non-dairy items are placed in a separate section departmentalizing The Proven way of increasing all food sales I'll buy it if I know it because I can see it that's a switch huh the operator can't help seeing Joel his past experience shows the outer stock problem will be greatly reduced the dairy clerk will take a new interest in keeping the case spotless she also has a much Sounder basis for reordering more the slow moving duplications have been removed stock turnover is rapid every Dairy item is always fresh mhm did DD happy as can be out ofd returns are at a minimum and the climaxing argument Joe wherever the balance Dairy department has been put into effect its sales have increased 14 to 37% with 8 to 20% of the increase being in high margin items like cheese some record to show a man a Joe that did it you got through to him and as an accepted member of the gross team you can go ahead now to demonstrate how well the balanced Dairy plan can be adapted to handling price and seasonal specials feel more important I do you can suggest other good merchandising ideas such as easy to see price and flavor card the proper rotation of stock ensuring fresh merchandise you can help stimulate a real product knowledge and all Dairy Personnel well what do you know who would ever think it when you get through to him Joe with a tailor made plan for his store the plan that increases his profits your stature as a dairy consultant goes up and so do your own sales the figures are proven figures Joe figures well persistent little thing there's all sorts of misinformation that's up there um so anyways I checked the copyright catalog of copyright uh for motion pictures in the ' 50s guess what there's two Jam handy films that came out um with the the title it figures one was for bendex Westinghouse automotive airbr company the other was for craft and so this is OCR and so they didn't do a very good job of it but uh it looks like yeah in fact you see it says if Figures it's uh it figures craft foods and then um it says May and then it says 553 so so uh I'm guessing based on the mus number or the MU number uh that it is one is 586 and the other is 588 that this came out in 55 I could look at an actual I don't have the volume with me but um that's the type of tedious research that we do sometimes we're like what year is this it didn't say in the copyright notice let's try to figure it out uh so that's what we do that's little a geekery there uh so yesterday we watched the informant part of that california series and uh that one had come from Craig Baldwin and this one is from our collection it's called forcible entry excuse and trickery this is how police officers gain access um and what they can get away with legally so enjoy for e n [Music] Jim we're going to have to kick this go ahead I'm set Kick It Go [Music] go get on the floor get down well that sounds good to me do you have any problems with the courts I just won the Supreme Court they threw it out well now why' they do that you had the consent of the wife you know there's some things about this knock and notice stuff that bother me how did I get you for a partner anyway what do you mean I mean where were you doing adley's lecture on excuse he laid it all out consent and everything oh yeah bet that's when I was off the cover for Jackson what do you say about consent come on I'll tell you normally before you can kick in a door you've got to knock announce yourself and explain why you're there right all right there's three main areas when you do not have to comply with any of those requirements like if the guy inside is trying to escape right or if he's trying to destroy evidence and the other times if there's going to be more chance of someone getting hurt if you do announce yourself than if you don't that's simple enough no not so simple you got to look at each situation separately you need specific information at the scene for instance Hadley was telling us about is that the house sure is 1636 M what do you think I think we kick it this dude knows we're outside he's going to try and do us how are we going to get by knock and notice well remember what record said about his uh last two arrests each time he's had a 45 with him you use it you see his rap sheet Lo with violence ADW is assault you name it look I want to nail this guy and I want this bust a stick but with prior information like that it's not going to get by knock a notice I think we should have something at the scene to use the officer is following recent cases in advising his partner that prior information about a suspect may not be sufficient to excuse non- compliance with knock and notice statutes those cases say that the common law exceptions to knock and notice pertain only to emergency situations at the time of entry in other words unannounced entry is excused only on the basis of emergency circumstances existing at the time an officer approaches a site to make an arrest or execute a warrant why don't you go around cover the back hold it there's a piece on the counter I think this guy's going to be in business come on over here door's locked we have to kick it and the Court held out a good entry they didn't have to knock and to explain why they were there they had specific information on the guy that he was probably armed and liked to shoot when resisting a RIS but most importantly they saw he had a weapon inside the house at the time of the arrest and was likely to use it and he was standing in a place where he had a right to be the front porch when he saw the gun what about a Nar case you know where the suspect can flush the stuff down the John before you finish your Spiel on the porch Hadley say there's a general rule about a case like that he said that it looks like they're not here yet how do you know there's supposed to be a green Matador parked out front surveillance team said they should be there by now what the hell why wait let's go in and get the evidence and then wait for him a it's fine mono you can't do that look we'll do everything right we'll knock tell them who we are and why we're here we'll even wait a few minutes before we kick the door that's great but it's illegal you got to have good faith belief that your suspect's actually inside before you go in otherwise the court will throw it out look somebody's coming [Music] [Music] officer Barnes was correct when he told his partner they needed a reasonable belief that the suspect was in the house before they could enter being experienced narcotics officers they know narcotics suspects usually try to destroy evidence if they realize police are nearby but this alone is not enough to excuse compliance with the kna notice rules compliance will be excused only if at the time the police act they have specific facts indicating that evidence is about to be destroyed common examples of such facts are retreating footsteps the sound of a flushing toilet or overheard statements from the occupants that they are going to destroy the evidence police officers down the joh in that case they didn't even get an opportunity to knock on the door the suspects gave them an excuse to go right in if you hear any sound like the flushing of a toilet or running footsteps or something that reasonably leads you to believe that the occupants are fleeing destroying the evidence or maybe going to get their weapons don't wait go right [Applause] in I forgot to tell you that Hot Pursuit ring Aid situations I know about those if a guy you're chasing runs into a building or another structure forget about knocking those and fall him right in same goes for rendering Aid situations you know if you hear moans or other noises that sound like an emergency good about knocking notice and where right in you're tremendous Jim I suppose tomorrow he'll be spouting off Cas citations to me listen there's Dicker I go your knock and notice theories in couri yeah it's a matter didn't you know the uh person giving consent Ander had to be within the premises you were really a big help weren't you consent to enter is a valid excuse for not complying with NOA notice requirements however the consent must be given by someone inside the premises as this last vignette demonstrates a consent given by one of the residents of a house when not inside of it is not sufficient however it is doubtful whether nakota statutes could protect trespasser if the absent householder gave police consent to Wier in order to remove [Applause] him an area close to related to knock and notice is entry by trickery or subterfuge the United States Supreme Court has told us there is nothing inherently unlawful in the use of police subterfuge and suppressing crime as long as constitutional rights are not invaded thus the use of undercover operations in such areas as narcotic buy programs has been approved by the courts however the California courts which tend to be stricter in these matters have disapproved such conduct as an officer's entry gained through his positive misrepresentation that he was an appliance repairman [Music] oh [Music] [Applause] [Music] [Applause] hey that neighbor might be right it sounds like a coke party yeah you can practically hear the snowfall Hey listen I got a way that we can get inside so we can find out exactly what's going on people have been going up to the door all day long and just knocking then they just go right in so why don't we just come on up to the door I mean that we uh just uh yeah what about knocking notice don't knock it if you haven't tried it well that's really funny winell but don't we have to they say come on in it'll be consent you mean we're just going to knock on the door state police officers conducting and kn otics investigation are you just going to say come in no no no we're going to knock just knock okay go [Music] ahead come on in the door is [Music] open come in to party [Music] police officer go in arrest everybody put your hands your head you get over here hey don't move don't move get over there come on right down here a California Supreme Court case held this type of police action legitimate because the officers made no positive Act of misrepresentation merely knocking on the door and being invited to come in is a consensual entry making compliance with knocka noce statutes unnecessary another creative entry Officer Jim Richardson you want to argue with the Supreme Court know but it's a little riskier why well how about no probable cause why should that make a difference all we want to do is have a look inside once he opens the door we're going to see Macy's basement anyway yeah well how much long is it going to be I don't want this crap around after Friday yeah yeah yeah I know but get this stuff out of here I mean how much longer can I tell the manager I'm still moving in huh fine all I want you to do is tell by the federal courts would find no illegality in the officer use of trickery here since they use no Force to gain entry however California courts which have set Trends in the search and seizure area now generally agree that if the police have no probable cause and use trickery to gain entry into a residence it is illegal note that in this case the officers use a positive Act of misrepresentation when they induce the manager to make false statements about the heater filters he's supposed to be here where is he here he comes I wonder if he made a buy [Applause] okay scobby how much half a piece that's good enough any more stuff well if you mean does it look like a pharmacy yeah it does well I checked the place out and that's the only exit are you sure that's his car over there hey man I'm sure there's a phone booth down on the corner I'm going to go do that and I'll meet you back here by the [Applause] car yeah uh say look this is a friend of scoby uh the Heat's making tracks for your place so you better get rid of your stuff yeah it's okay forget it I wonder if he's going to bite wait I think he's coming police officer going to talk to [Applause] you all right left hand on your head left hand on your head because there was no entry but merely a ruse to draw the suspect out of his dwelling this type of police action has been approved by the courts the police were only providing an opportunity for Munger to incriminate himself they did not use trickery to gain entry into his home now what have we learned we have learned that an entry by police who do not comply with Naka noce requirements is permissible only in emergency circumstances and in addition these emergency circumstances must be present at the the police are approaching the site unannounced entries based on prior information that an emergency may exist is not sufficient the three most common reasons for an unannounced entry are that the evidence will be destroyed the suspects will escape or the danger to the officers will increase if the rules are complied with but prior knowledge that the suspects might destroy evidence or Escape or shoot is not sufficient and remember police do not have to knock and announce where they are in Hot Pursuit or need to under emergency aid another important point is consent consent to Winter must be given by persons within the structure however if the person in the house is a trespasser it is doubtful whether he would be protected by typical knocka notice statutes if an absent householder gave police consent to enter as to trickery aruse remember that it's an unsettled area but that you can probably use these devices where you have probable cause and you perform no positive Act of misrepresentation lastly remember that the courts apparently do permit training films that talk about all of this um and some of them are really good they're smart they talk about um the difficulties of this and they talk about what is not allowed and that's important um
